Your Content and Material
By submitting any content or materials, including but not limited to photographs, videos, images, text, graphics, and other creative designs (collectively, "Designs") to VividCustoms through the Services, you are agreeing to the terms outlined in this Policy and our User Agreement. While you retain ownership of your submitted Designs, you grant VividCustoms a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, distribute, create derivative works from, publicly display, and archive your Designs in connection with the production or provision of any products or services requested by you, or to demonstrate how your Designs may appear on our products or services.
Specifically, this license includes the right for VividCustoms to prepare, manipulate, and utilize the Designs for merchandise production, packaging, shipment, and for marketing and promotional activities across various media channels. Additionally, each user of the Services is granted a non-exclusive license to access your Designs through the Services, subject to the limitations set forth in this Policy and the User Agreement.
You warrant that you own or possess all necessary rights for the use of the Designs and that they do not infringe or violate any third-party intellectual property rights, privacy rights, or any laws. Furthermore, you assert that the Designs are free from any claims, disputes, or potential litigations regarding intellectual property rights or other rights.
Obligations and Representations
By uploading Designs to the Services, you assume full responsibility for ensuring their compliance with this Policy. VividCustoms may, at its discretion, review Designs submitted as part of an order for compliance with this Policy. VividCustoms reserves the right to refuse service, suspend order processing, or remove access to any Designs that do not comply with this Policy or the User Agreement.
You agree to provide VividCustoms with written confirmation of all rights, licenses, permissions, and consents obtained by you with respect to the Designs upon request. Failure to provide satisfactory confirmation may result in the removal of your Designs from the Services and the suspension or termination of your account.
Use of Personal Image and Likeness
You consent to the use of your name, image, and likeness, and confirm that you have obtained written consent, release, and/or permission from every identifiable individual in your Designs for the use of their name, image, and likeness in accordance with this Policy. For individuals under eighteen, you have obtained such consent from their parent or guardian.
Indemnification
You agree to indemnify and hold harmless VividCustoms and its affiliates against any claims, damages, liabilities, or costs arising from your violation of this Policy, the User Agreement, or any applicable laws, including but not limited to those related to your Designs.
VividCustoms Content
All content created by VividCustoms, including graphics, images, text, and software tools, is the property of VividCustoms or its licensors and is protected by copyright and trademark laws. Use of VividCustoms content without express permission is strictly prohibited.
Reporting Infringement
VividCustoms is committed to addressing claims of copyright and trademark infringement. If you believe that your intellectual property rights have been infringed by material on the Services, please contact us at legal@vividcustoms.com with detailed information, including evidence of ownership and a description of the infringing material.
Amendments to This Policy
